Pudukottai, Tirunelveli and Thoothukudi should be declared caste atrocity-prone districts, NGO demands

The rising number of crimes against members of the Scheduled Castes (SCs) are alarming, and the Tamil Nadu government should immediately declare Tirunelveli, Thoothukudi and Pudukottai as ‘caste atrocity-prone’ districts, demanded A. Kathir, executive director, Evidence, a Madurai based NGO that works towards the protection and promotion of Dalit and tribal rights.

Speaking to media persons on Monday, November 6, 2023, Mr. Kathir said that the death by suicide of a 16-year-old boy from Koppampatti village in Pudukottai district on Saturday (November 4), was an example of atrocities against the SCs. “The boy’s crime was speaking to a girl who was of an intermediate caste. Is this a crime,” he asked

Educational institutions in districts like Pudukottai, Tirunelveli and Thoothukudi are filled with caste conflicts, Mr. Kathir alleged. The Tamil Nadu government and the Minister concerned in these matters have miserably failed to contain the spread of violence against Dalits in school campuses. While Dravidian parties showered encomiums on (late leaders) Periyar and Anna for their ideologies, such atrocities taking place in the same soil these leaders hailed from, was shameful and distressing, he said.

Tamil Nadu, which has been claiming to be a champion in social justice and equality, is seeing what appears to be a rise in heinous crimes against the marginalised, and the custodians of the law are merely blaming the victims rather than taking punitive action against the perpetrators, Mr. Kathir alleged.

Chief Minister M. K. Stalin, he said, has failed in his duty to protect SCs. Stringent action must be taken against the instigators of the death of the 16-year-old in Pudukottai district, and the investigation should be swift and transparent, he added.

Vengaivayal incident in cold storage

Stating that the Pudukottai case was not a stray incident, Mr. Kathir said the number of crimes against SCs had risen manifold. “No action has been taken against the accused in heinous crimes unleashed against the Dalits over the past two years,” he charged.

The Vengaivayal incident in Pudukottai district, where faeces was found in a tank that provided drinking water to Dalits in the village, reported last year, has only been dragging on, without any firm action taken so far. While the government had formed a Commission to probe the incident, no one has been held as an accused person, to date. What is the police doing, he asked and said that in the case of the Nanguneri Dalit boy who was attacked, the accused (juvenile offenders) have been granted bail. In many other such crimes too, the accused persons were enlarged on bail, he said.

A recent modus operandi in atrocities against Dalits was to make juveniles commit heinous crime, as it enabled them to face fewer legal complications, Mr. Kathir charged. He urged CM Stalin to directly review these cases, which alone would instil confidence in the marginalised communities in T.N., he said.

Mr. Kathir further said that though a high-level committee with 63 members headed by the T.N. CM was being held twice in a year after the DMK government came to power, the atrocities had not declined. In reality, the crimes have increased. There is no follow up process, he said and urged the T.N. government to give ₹25 lakh as a compensation to the young boy’s family in Pudukottai, and arrest all the accused without delay.

ஆற்றங்கரையில் குளிக்கச் சென்ற பட்டியலின இளைஞர்கள் கஞ்சா போதையில் இருந்தவர்களிடம் சிக்கியது எப்படி? தோப்பில் வைத்து இளைஞர்களை என்ன செய்தார்கள்?

திருநெல்வேலி மாவட்டம் மணி மூர்த்தீஸ்வரம் கிராமத்தில் ஆயிரக்கணக்கான பட்டியல் சமூக மக்கள் வசிக்கின்றனர்.

மணி மூர்த்தீஸ்வரம் என்ற பகுதி தாமிரபரணி ஆற்றங்கரையில் இருந்து அரை கிலோமீட்டருக்கும் குறைவான தொலைவில் ஆற்றின் ஓரத்தில் அமைந்துள்ளது. அந்தப் பகுதியில் வசிக்கும் மக்கள் காலை, மாலை வேளையில் ஆற்றில் குளிப்பது, ஆடு, மாடுகளை மேய்ச்சலுக்கு அழைத்துச் செல்வது, துணிகளைத் துவைப்பது போன்ற பணிகளை மேற்கொள்வதை வழக்கமாக வைத்துள்ளனர்.

அந்த கிராமத்தைச் சேர்ந்த இளைஞர்கள் இரவு நேரங்களில் பணி முடித்து வரும் வழியில் ஆற்றில் குளித்துவிட்டு வீட்டுக்குச் செல்வது வழக்கம்.

அங்கு இரவு நேரத்தில் பல்வேறு பகுதியைச் சேர்ந்தவர்கள் ஆற்றின் கரையில் அமர்ந்து மது, கஞ்சா உள்ளிட்ட சட்டவிரோத செயல்களிலும் ஈடுபட்டு வருகின்றனர். இதை எடுத்துக் காட்டும் விதமாக ஆற்றின் கரையோரம் முழுவதுமே ஆங்காங்கே மது பாட்டில்கள், பிளாஸ்டிக் கப்புகள், குடிநீர் காலி பாட்டில்கள், புகைத்துண்டுகள் கிடந்தன.

நெல்லை பட்டியலின இளைஞர்கள் தாக்கப்பட்ட விவகாரம்

மணி மூர்த்திஸ்வரத்தைச் சேர்ந்த 21 வயது இளைஞர் மற்றும் அவரது 19 வயது நண்பர் என பட்டியலின இளைஞர்கள் இருவரும் தனியார் நிறுவனத்தில் கேபிள் லைன் கொடுக்கும் பணியைச் செய்து வருகின்றனர். இவர்கள் கடந்த அக்டோபர் 30ஆம் தேதி மாலை 7 மணி அளவில் ஆற்றங்கரையில் குளிப்பதற்காகச் சென்றுள்ளனர்.

அந்த நேரத்தில் ஆற்றின் கரையோரமாக ஆதிக்க சாதியைச் சேர்ந்த 4 இளைஞர்கள் அமர்ந்து கஞ்சா புகைத்துக் கொண்டு இருந்ததாக இந்தச் சம்பவம் குறித்து காவல்துறை தரப்பில் கூறப்படுகிறது.

இவர்கள் குளிக்கச் செல்வதைப் பார்த்த ஆதிக்க சாதியைச் சேர்ந்தவர்கள் இவர்களை அழைத்து செல்போன்களை பறித்துக்கொண்டு, பணம் கேட்டு மிரட்டியதாக போலீசார் தரப்பில் கூறப்படுகிறது. மேலும் இருவரையும் வயிற்றில் கத்தியை வைத்துப் பணம் வேண்டுமென மிரட்டியதாகவும் காவல்துறை கூறுகிறது.

பின்னர், “இருவரையும் நிர்வாணப்படுத்தி பட்டியலின இளைஞர்களை அவர்களது முதலாளியிடம் தொலைபேசியில் பேச வைத்து 5000 ரூபாயை இவர்களது வங்கிக் கணக்கில் வரவு வைக்கச் செய்து பிறகு ஏ.டி.எம் கார்டை எடுத்துக் கொண்டு இவர்களின் சாதியைக் கேட்டுள்ளனர். பட்டியல் சமூகத்தைச் சேர்ந்தவர் என்று கூறியதை அடுத்து ஒருவர் மீது சிறுநீர் கழித்து 4 மணிநேரம் வைத்து கொடூரமாகத் தாக்கி இருக்கின்றனர்.

அவர்களிடம் இருந்து தப்பி உடலில் ஒட்டுத் துணி இல்லாமல் நிர்வாணமாகவே வீட்டுக்கு ஓடிச்சென்ற இருவரையும் அவர்களது உறவினர்கள் மீட்டு திருநெல்வேலி அரசு தலைமை மருத்துவமனைக்கு அனுப்பி வைத்தனர்,” என்று காவல்துறை வழக்குப் பதிவு செய்துள்ளது.

இது தொடர்பாக தச்சநல்லூர் காவல்துறையினர் 6 பேரைக் கைது செய்து விசாரணை நடத்தி வருகின்றனர்.

இந்த சம்பவத்தில் கொடூரமான தாக்குதலுக்கு உள்ளாக்கப்பட்டு கண்பார்வை பாதிக்கப்பட்ட பட்டியலின இளைஞர் அதுகுறித்து பிபிசி தமிழிடம் பேசியபோது, “உயிர் பிழைத்தால் போதும் என நிர்வாணமாகவே ஓடினோம்” என்கிறார்.

“நாங்கள் வழக்கமாகப் பணியை முடித்துவிட்டு வரும்போது ஆற்றில் குளிக்கச் செல்வோம். கடந்த அக்டோபர் 30ஆம் தேதி மாலையும் அதேபோல் சென்றோம்.

அப்போது கஞ்சா போதையில் இருந்த 4 பேர் எங்களை அழைத்தனர். அருகில் சென்றபோது எங்களைப் பிடித்து அடித்து செல்போன்களை பறித்துக் கொண்டு எங்களிடம் பணம் கேட்டனர். இல்லை எனக் கூறினோம்.

இதையடுத்து ஆற்றின் கரையில் இருந்து 300 மீட்டருக்கு அப்பால் உள்ள மரத்தில் எங்கள் இருவரையும் தனித்தனியாகக் கட்டி வைத்து நிர்வாணப்படுத்தி அடித்து எங்களின் கேபிள் ஓனருக்கு போன் செய்யச் சொன்னார்கள். நானும் போன் செய்தேன்,” என அன்று நடந்தவற்றை விவரித்தார்.

தாங்கள் மது அருந்தி, போலீஸிடம் சிக்கிக் கொண்டதாகக் கூறி 5,000 ரூபாய் போடச் சொல்லுமாறு கத்தி முனையில் அவர்கள் மிரட்டியதாகவும், உயிருக்குப் பயந்து தானும் அவர்கள் கூறியதை அப்படியே செய்ததாகவும் பாதிக்கப்பட்ட பட்டியலின இளைஞர் கூறினார்.

தாங்கள் இருவரும் வந்த இருசக்கர வாகனத்தை எடுத்துக்கொண்டு அந்தக் கும்பலில் இருந்த இருவர் சென்றனர் என்றும் இருவர் தங்களுக்கு காவலாக இருத்தப்பட்டதாகவும் அவர் தெரிவித்தார்.

TIRUNELVELI: A police constable has been placed under suspension for allegedly leaking a video conversation between the police and a juvenile suspect, apprehended for allegedly murdering an 18-year-old SC girl. A selfie that the sub-inspector took with the suspect also went viral on social media.

Deputy Inspector General of Police, Tirunelveli range, Parvesh Kumar confirmed the suspension of the grade-1 constable Jebamani and said the video was taken for internal purposes only. On Monday afternoon, the 17-year-old juvenile allegedly murdered the girl by slitting her throat when she was at a godown of a fancy store, where she was working, near the Nellaiappar temple. The reason for the murder is said to be the girl’s denial to the juvenile’s proposal for a relationship.

The city police alerted Moolakaraipatty police, following which police personnel including inspector Meeral Banu, and SI Sakthi Natarajan nabbed the juvenile. Jebamani allegedly shot two videos during the inquiry. Sakthi Natarajan allegedly took a selfie with the juvenile and the other constable. On Thursday, SP N Silambarasan conducted an inquiry and suspended Jebamani. The provisions of the Juvenile Justice Act and guidelines issued on various court orders for the arrest of the juvenile were discussed during the inquiry, sources said. In the video, the police are seen consoling the juvenile and checking his body for self-inflicted wounds.

Sub-inspector was earlier transferred for similar act
It is to be noted that Sakthi Natarajan was one of the police officials who were transferred to Range Vacancy Reserve from Ambasamudram division after the custodial torture, in which the suspended IPS officer Balveer Singh is prime accused, came to light. At that time, Natarajan was accused of shooting a video of a juvenile victim’s mother, threatening her to talk in favour of the police. The video was later allegedly released by Sakthi Natarajan on social media. Sources said Sakthi Natarajan was rapped for his continuous activities during the inquiry, but no action was taken against him.

‘Treat juvenile suspect in SC girl murder as adult criminal’

MADURAI: In the wake of the alleged murder of an 18-year-old SC girl at the hands of a 17-year-old caste Hindu stalker in Tirunelveli, executive director of Evidence A Kathir demanded the state to issue a GO ordering a hearing of all cases against juvenile caste Hindus involved in heinous crimes against SC community, in the special court instead of dealing it in the juvenile justice board (JJB).

Kathir said the number of juvenile boys involved in heinous crimes against SCs has gone up. “They get bail easily and are mostly spared from punishments on account of their age. The accused juvenile caste Hindu boys deliberately performed such crimes, including murder and sexual assaults,” Kathir said, adding that the governments, however, have not considered the crime against SCs as heinous crimes.

He further said the government has to consider the crime against SCs by caste hindu juveniles as heinous and hear the case in a special court for exclusive trial cases registered under the SC/ST Act instead of JJB. “The arrest, bail, inquiry, and other procedures have to follow the treatment given for adults. The state has to provide a Rs 25 lakh compensation to the immediate relative of the victim girl. In the girl’s murder, the juvenile must not be provided bail and police must also add a section 354 D IPC in the FIR,” Kathir added.

‘A heinous crime should not get diluted just because the attacker is a juvenile’

In the recent attacks on people belonging to Scheduled Castes (SC), the perpetrators were mostly juveniles. To prevent such crimes, these cases should be treated as heinous and the offenders punished without showing any leniency, said A. Kathir, executive director of Evidence, a Madurai-based organisation.

Speaking to The Hindu, he said that in the latest attack in Tirunelveli City, a 18-year-old SC girl was targeted by a 17-year-old youth from an intermediate caste. “After the girl spurned his love, the boy hacked her to death in broad daylight on October 2. Though he was arrested, he will certainly come out on bail soon as he is a juvenile,” said.

Such crimes should not be treated as something committed by an adult or a juvenile. The recent pattern of atrocities against the Dalits showed that most of the crimes were committed by youth aged below 18.

A fact-finding team from the Evidence visited Tirunelveli on Wednesday and talked to the parents of the victim. The girl was working in a shop for a meagre salary. She had reasoned with the boy that she cannot marry him since they belonged to different communities. But the youth killed her.

Similar crimes
A teenaged Dalit boy and his younger sister were attacked by their schoolmates in Nanguneri on August 9. Five teenaged boys attacked a Dalit in Kazhugumalai on August 17. A four-member gang attacked a Dalit boy at Kolakaranpatti in Karur district. A 17-year-old Dalit boy was hacked by a juvenile at Ottapidaram on September 2.

The police registered cases, the juveniles obtained bail and sent to borstals.

But, a heinous crime should not get diluted just because the attacker was a juvenile, Mr. Kathir said and added that the government must examine the modalities to amend laws to this effect.

The police should register IPC Section 354 D against the accused in the October-2 murder. The Tamil Nadu government should give a compensation of ₹25 lakh to her family. The juvenile who killed her should not be granted bail.

Besides, all pending cases against Dalits should be taken up and chargesheets filed within a time frame. The cases should be taken up in trial courts and judgments delivered within 100 days, Mr Kathir added.
