Activist Kausalya has urged the Tamil Nadu government to take all-out efforts to ensure that the appeal preferred in the Supreme Court against the Madras High Court judgment in the Udumalpet honour killing case is listed for further hearing early.
Pointing out that the appeal preferred in the Supreme Court against the Madras High Court judgment in the Udumalpet honour killing case was pending for nearly three years, activist Kausalya has urged the Tamil Nadu government to take efforts to ensure the appeal was listed for further hearing early.
Addressing a press conference organised by Evidence, an NGO fighting for the cause of Scheduled Castes and Scheduled Tribes, in Madurai on Wednesday, Ms. Kausalya said that Chief Minister M. K. Stalin, when he was in the opposition in 2020, offered support to her. She urged the State government to take necessary steps in this regard.
In 2016, V. Shankar, a Scheduled Caste youth, and Kausalya, a Caste Hindu, were attacked by a gang with lethal weapons in Udumalpet in Tiruppur district after they got married against the wishes of Kausalya’s family. While Shankar died on the spot, Kausalya sustained serious injuries in the attack.
In 2017, the Principal District and Sessions Court in Tiruppur awarded death sentences to six persons, including B. Chinnasamy, father of Kausalya, and different jail terms to the other accused. In 2020, the Madras High Court acquitted the prime accused, Chinnasamy, and commuted the death sentences of five others to life sentences.
The Tamil Nadu government preferred an appeal in the Supreme Court against the judgment the same year. Ms. Kausalya said that the Supreme Court had admitted the criminal appeal in 2020 and the appeal was still pending at the same stage and not even taken up for further hearing.
Mr. Kathir, executive director of Evidence, urged the State government to give more attention to the case. The State was not taking efforts to get the matter listed for further hearing, he said. He wondered if this was due to vote bank politics. The urgency shown in other matters was not being shown in this case, he said.
Answering a query on the need for a law against honour killings, he said that in Tamil Nadu honour killings were on the rise and despite several drafts being prepared in this regard, unfortunately no law has been enacted so far. He pointed out that the district level special cells to protect inter caste couples were not even functioning.

The government had not taken strong efforts to get the matter listed for further hearing. The seriousness of the case should be considered. Otherwise, it could encourage the offenders, he added.
In a letter sent to the Chief Minister, Ms. Kausalya narrated the horrific incident leading to the death of Shankar and the case before the trial court and the Madras High Court. She urged the Chief Minister to extend support. The government should show special attention and urgency in the case, she said.

கோவை மாவட்டம், கிணத்துக்கடவு ஒன்றியம், தேவராயபுரம் ஊராட்சித் தலைவி சுந்தரி, ‘முதல்முறையா எங்க ஊராட்சி, பட்டியல் பழங்குடியினருக்கு ஒதுக்கப்பட்டது. ஆனா, மக்கள் ஆதரவோடு வெற்றிபெற்ற என்னை ஆதிக்க சாதியைச் சேர்ந்த துணைத் தலைவர் சுதந்திரமா பணியாற்ற விடுறதில்லை. அலுவலகத்துக்கு வரக் கூடாது, சேர்ல உட்காரக் கூடாதுன்னு தொடர்ந்து பிரச்னை செய்யுறார். இன்னொரு பக்கம், ‘நீ பழங்குடிதானே, உனக்கு ஒண்ணும் தெரியாது. நாங்க சொல்றபடி செஞ்சா போதும்’னு அதிகாரிங்களும் மிரட்டுறாங்க. ஊருக்கு என்ன செய்யணும்னு கஷ்டங்களை அனுபவிச்ச எனக்கு நல்லா தெரியும். ஆனால், எந்த வேலையும் செய்யவிடாம, பொய்யான பெட்டிஷன்களை போட்டு துணைத் தலைவர் எங்களைத் தொந்தரவு செய்கிறார். அவர்கிட்டருந்து எங்களைக் காப்பாத்தினாலே போதும்’’ என்றார்.
களக்காடு ஒன்றிய ஊராட்சித் தலைவர் அய்யம்மாள், “ஏற்கெனவே 25 வருடங்களாக ஒரே தலைவர் இருந்த ஊராட்சியில், முதன்முறையாகப் பட்டியலின ஊராட்சித் தலைவராக நான் வந்திருப்பதை அவர்களால் ஏற்றுக்கொள்ள முடியவில்லை. கடந்த முறை அவர்கள் பொறுப்பில் இருந்தபோது ஏகப்பட்ட வீடுகளுக்கு போலி ரசீது போட்டு வரி வசூலித்திருக்கிறார்கள். ‘நீயும் அப்படியே செய்’ என்று அதிகாரிகள் சொல்கிறார்கள். அவர்கள் சொல்வதை நான் கேட்காததால், எங்கள் ஊருக்கு எந்தத் திட்டத்தையும் ஒதுக்காததோடு, ஆய்வு என்ற பெயரில் அடிக்கடி வந்து தொந்தரவு செய்கிறார்கள்’’ என்றார்.
கடலூர் மாவட்டம், பெரியகுமட்டி ஊராட்சித் தலைவி மரகதம், “அனைத்துக் கட்சியில் இருப்பவர்களும் சாதிரீதியாக ஒன்று சேர்ந்து என்னைச் சுதந்திரமாகச் செயல்படவிடாமல் தடுத்தார்கள். ஊராட்சியைப் பற்றி அவதூறு பரப்பினார்கள். அவர்களின் அழுத்தத்தால் எம்.பி., எம்.எல்.ஏ., யூனியன் சேர்மன் ஆகியோரும் மேம்பாட்டு நிதிகளை தலித் ஊராட்சிகளுக்கு ஒதுக்குவதில்லை. எந்த நிதியாக இருந்தாலும் சண்டை போட்டு, போராடித்தான் வாங்க வேண்டியிருக்கிறது. பட்டியல் சாதி ஊராட்சிகளுக்கென தனியாக நிதி இருந்தால் இந்தப் பாகுபாடு இருக்காது” என்றார்.
இந்தக் கலந்தாலோசனைக் கூட்டத்தை ஏற்பாடு செய்த எவிடென்ஸ் அமைப்பின் இயக்குநர் கதிர் நம்மிடம் பேசியபோது, “தமிழகத்தில் 19 மாவட்டங்களில் 114 பட்டியலின ஊராட்சித் தலைவர்களிடம் எவிடென்ஸ் அமைப்பு சார்பில் கள ஆய்வு நடத்தப்பட்டது. அதில் கிடைத்த தகவல்கள் அனைத்தும் அதிர்ச்சிதரக் கூடியவை. கிருஷ்ணகிரி மாவட்டம், தாரவேந்திரம் ஊராட்சித் தலைவர் நரசிம்மமூர்த்தி கற்களாலும் கட்டையாலும் அடித்துக் கொலை செய்யப்பட்டிருக்கிறார். ஊத்துமலை, வேடல், பிரமனூர் ஊராட்சித் தலைவர்கள், அவர்களின் உறவினர்கள் ஆகியோர் ஆதிக்க சாதியினரின் கொடூரத் தாக்குதலுக்கு உள்ளாகியிருக்கிறார்கள். நான்கு பெண் ஊராட்சித் தலைவர்களுக்கு பாலியல்ரீதியான துன்புறுத்தல்களும் நடைபெற்றிருக்கின்றன.
மதுரை மாவட்டத்தில் பழையூர் பட்டியலின ஊராட்சித் தலைவர் வித்யாவை சாதிரீதியாக இழிவுபடுத்திப் பேசியதோடு, 2021-ம் ஆண்டு தண்ணீர் தொட்டியிலும் மலம் கழித்திருக்கின்றனர். 2022-ம் ஆண்டில் ஊராட்சி மன்ற அலுவலக வாசலிலேயே மலம் கழித்து வைத்திருக்கின்றனர். ஊர் குளியல் தொட்டியில் இதுவரை 15 தடவைக்கும் மேல் மலம் கழித்து, மோசமான முறையில் இழிவுபடுத்தியிருக்கின்றனர். இது குறித்துப் புகார் கொடுத்தும் இதுவரை போலீஸ் எந்தவொரு நடவடிக்கையும் எடுக்கவில்லை.
கடந்த ஓராண்டில் மட்டும் 12 பட்டியலின ஊராட்சித் தலைவர்கள் தேசியக்கொடியை ஏற்றவிடாமல் தடுக்கப்பட்டுள்ளனர். 11 ஊராட்சித் தலைவர்களை நாற்காலியில் அமரவிடாமல் தடுத்திருக்கிறார்கள். கோயில் திருவிழாக்களில் பட்டியலின ஊராட்சித் தலைவர்கள் 45 பேருக்கு சாமி தரிசனம் செய்ய அனுமதிக்காத நிலை இருக்கிறது.
தமிழகத்தில் 32 மாவட்டங்களில் எஸ்.சி., எஸ்.டி ஆணைய கண்காணிப்புக் கூட்டங்கள் முறையாக நடப்பதில்லை; அதன் தலைவரான மாவட்ட ஆட்சியர்களே கலந்துகொள்வதில்லை. தமிழக அளவில் இது போன்ற சாதியப் பாகுபாடுகள் குறித்துக் கண்டறிய கண்காணிப்பு அலுவலர்களை நியமிக்க வேண்டும். பட்டியலின ஊராட்சித் தலைவர்களை தேசியக் கொடியை ஏற்றவிடாமல் தடுப்பவர்களை தேசத்துரோக வழக்கில் கைது செய்ய வேண்டும். தமிழகம் முழுவதுமுள்ள பட்டியலின ஊராட்சிகளில் சிசிடிவி கேமராக்கள் அமைக்க வேண்டும்.
நாங்கள் எடுத்திருக்கும் கள ஆய்வு அடிப்படையில், பாதிக்கப்பட்ட ஊராட்சித் தலைவர்கள் உயர் நீதிமன்றத்தில் வழக்கு தொடரவிருக்கிறார்கள். சமூகநீதி பேசும் தமிழக அரசு, பட்டியலின ஊராட்சித் தலைவர்களுக்கு எதிராக நடைபெறும் குற்றங்கள்மீது கடுமையான நடவடிக்கை எடுக்க வேண்டும்’’ என்றார்.
சமூகநீதியை உரக்கப் பேசும் தி.மு.க ஆட்சியிலாவது இந்தக் கொடுமைகளுக்கு முற்றுப்புள்ளி வைக்கப்படுமா?!
